These Terms of Service (the "Terms") govern your use of the xway.si website (the "Website") and any purchase made through it. The Website is operated by PNEUS 4X4 d.o.o., trading as XWAY POWERSPORTS, with its registered office at Ulica Bojana Vodopivca 5, 5294 Dornberk, Slovenia, Company Registration No. 1673645, VAT ID SI40625940 (referred to below as "XWAY", "we" or "us").
By using the Website or placing an order, you agree to these Terms. If you are a consumer resident in the European Union, nothing in these Terms limits the rights you are entitled to under the mandatory consumer protection law of your country of residence - those rights always take precedence over any conflicting provision here.

2. Formation of the contract
Products displayed on the Website are an invitation to order, not a binding offer from us. When you place an order, you receive an e-mail confirming we have received it - this is not yet acceptance. The contract is formed once we confirm by e-mail that your order is being processed or has shipped.
All prices on the Website are in euros (EUR) and include VAT, unless stated otherwise. Delivery costs are shown separately before you complete your order.
We reserve the right to refuse or cancel an order - for example in the case of a pricing or description error, out-of-stock items, or reasonable suspicion of misuse. If this happens, we will notify you and refund any payment already made in full.
3. Delivery and payment
Details of delivery methods, timeframes and costs are set out in our Shipping Policy. Available payment methods are shown at checkout.
4. Right of withdrawal (14 days)
If you are purchasing as a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. Details, procedure and exceptions are set out in our Refund and Withdrawal Policy, which forms an integral part of these Terms.
5. Legal warranty for defects
Independently of the right of withdrawal, as a consumer you are entitled to claim for defects in the goods under the Slovenian Code of Obligations and Consumer Protection Act. This right is separate from any manufacturer's commercial warranty and lasts 2 years from delivery. Please report a defect to info@xway.si as soon as you notice it, together with a photo, a description of the issue, and proof of purchase.
Some products carry an additional manufacturer's commercial warranty; its terms are stated on the product or in the accompanying documentation and do not limit your statutory rights.
6. Your obligations when using the Website
You must not use the Website for unlawful purposes, to transmit harmful code, or to attempt unauthorised access to our systems. Information you provide when ordering (name, address, contact details) must be accurate and kept up to date.
7. Limitation of liability
We take care to keep product information on the Website accurate, but we cannot guarantee it is always complete or error-free (for example, a typographical error in a price or description) - in such a case we will notify you before processing your order and offer you the option to withdraw. Our liability for damages is limited to the extent permitted by law; nothing in these Terms limits liability for intent, gross negligence, personal injury, or any right granted to consumers by mandatory law.
8. Dispute resolution
For any complaint, please contact us first at info@xway.si - we aim to resolve every dispute amicably and quickly. If you are a consumer resident in the EU, you may also submit a dispute relating to your online purchase through the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Disputes that cannot be resolved amicably fall under the jurisdiction of the competent court in the Republic of Slovenia, without prejudice to any mandatory rights a consumer may have under the law of their country of residence.
9. Changes to these Terms
We may update these Terms from time to time. The version published on this page at the time you place your order applies.
10. Governing law
These Terms are governed by the law of the Republic of Slovenia, without prejudice to any mandatory provisions in favour of the consumer under the law of their country of residence.
